Kellogg man seeks dismissal of quadruple murder charges citing lack of evidence

BOISE, Idaho (CBS2) According to court documents, Majorjon Kaylor,suspected of killing four people who lived next door to him in Kellogg, Idaho, and his defense moved to have the charges against him dismissed.

According to court documents, Majorjon Kaylor,suspected of killing four people who lived next door to him in Kellogg, Idaho, and his defense moved to have the charges against him dismissed.

Kaylor pleaded not guilty to four counts of first-degree murder after the state alleged he shot and killed his four neighbors.

The defense says the state has not provided any evidence to prove the alleged counts were "perpetrated by means of poison; lying in wait; torture; to execute vengeance; to extort something from the victim; to satisfy some sadistic inclination; by any kind of willful, deliberate and premeditated killing; or in the course of the commission of a qualifying felony."

They argue the state cannot sustain the burden of proving the first-degree murder charges.

A hearing for the motion is scheduled for Nov. 6.
